Default I was ACCUSED of shoplifting, in the US and I live in Canada can i still travel to the US?

In April i was accused of shoplifting by a store i was in. She took me to security and they took all my info.. they sent a letter home saying i wasnt allowed back in the mall for 6 months. Then i got another letter from th store saying if i owed them 200$ and paid it within 30 days that would settle it. They never took me to police and the security gaurds said they were giving me a huge break. i plan on paying the 200$ even though i didnt do it. If i go on vacation to the US and cross the border will they have any record of it and can i still cross without a problem? please help ! On the letter they said it was for an alleged theft offence.. does that mean its a criminal record ? Please Help !

If you were not arrested, were not fingerprinted or taken to court and arraigned, there is not official record of this. Pay the store fine and be done with it.

The only way it would show up in NCIC is if you where run through the system, which it appears you where not. Immigration does not have access to internal store records.

Pay the fine and its a done issue.

If they didn't call the police then you don't have a record.

EDIT: stop worrying they are just bluffing, if they did not call the police and you were'nt taken to jail and fingerprinted and had to bond out and was not given a court date they don't have a leg to stand on. If they were gonna press charges they should have done it back then, there is NO PROOF of their accusations. Forget it, you don't even have to pay the money.....

You can travel freely. You have nothing to worry about on that front.

And don't pay that fine. You don't owe them anything.

if you go back to the U.S. you cant go to that store its like one of my cousins who lives in georgia shoplifted something but he was able to come back to South Carolina but not go back to that store for 3 months.

if you didn't do it you should fight it. I mean why pay a mall or a department store for a crime you did not commit. 200 dollars is 200 dollars and That is a lot of money. I would not let this go. If you are truly innocent do not let them take advantage of you.

Personally, I don't like the idea of privately enforcing laws and demanding money for not reporting an offender to the police. It all smells like blackmailing, and I don't want anything of that!

From what I can gather about your situation, you seem to be in a private quarrel with a shopping mall, and not with law enforcement. As long as it stays that way, you should be fine and you can cross the border as many times as you please.

Right now, you haven't been arrested, so you don't have a US criminal history.

However, you made an agreement with the store. Pay them the $200 and they don't report you to the police. If you don't pay it, they will report it and they will use the statement they had you sign against you in criminal court
