Here in Austin Texas we have just found out that our police cheif will be seeking government funding to have officers trained to draw blood so that in the event you are pulled over for DWI and refuse the breathalizer they can get a search warrant to draw blood from you. I think this is a major infringment of rights and while I have no record and personally don't drink and drive I don't want an officer with the rights to draw my blood or for a search warrant to do so to become an easily assessible item. I am for keeping every right possible... Do other states/cities have this? Does it work? What do you think? I also worry that more people will act out against our officers and run from the law as they will no longer be able to refuse.
Here is the story: http://www.kxan.com/Global/story.asp?S=8581029 We currently have the right under Texas law to refuse a breathalizer which results in a 90 day suspension of your license and generally a night in jail as they take you in for refusal. I don't want a cop to have any rights to touch me or draw blood that is what a medical professional is for. Also shouldn't our city look into running busses on Friday and Saturday nights to 3 AM to provide safe alternatives to driving, when did our society decide to punish only instead of providing services? |

It probably does infringe on one's rights a little...but if someone under the influence does refuse, what's so wrong about making them take a blood test? They have a right to not take the test, but I too have a right to not get injured by a drunken driver.

I think a blood test is way more reliable than a breathalizer and I would opt for that before blowing the tube.
However, I DO NOT want a police officer to do it. I want an independent medical assistant, or nurse or ER doc to do it instead and I want it tested in the hospital lab AND sent to an independent lab elsewhere of my choosing. |

This is Hitler. I'm sorry Adolf didn't think up the War on Drugs, but he should have. America would have raised the dictator up to sainthood if he had only drug tested for cigarettes and incarcerated offenders with appropriate punishment(s).
