Hi, I want to apply for a K1 visa to bring my fiancee from China to the US. However, from what I hear, it takes roughly 1 year from beginning to end.
In the mean time, while the K1 visa is in process, can she apply for a B2 visa to come a little earlier for visit only? Thanks! Thanks for your great answers! I'm wondering, what if she applies for the B2 visa first, and then apply for the K1 visa? Would that make things easier? I have read that the immigration officials may still not let her in on a B2 visa with a pending K1 visa? Thanks! |

B1/B2 visitor visa is an nonimmigrant visa which does not allow dual intent. dual intent refers to the concept that certain visitors may be temporarily present in US while acting in a manner that later leads to obtaining lawful permanent residence (green cards). if your fiancee has a pending k1 visa petition for her, her B1/B2 visitor visa application will likely be denied. same thing applies to other nonimmigrant visa. if she intent to hide the fact that she will come to US with the intention to get married to you so she can obtain visa, that would create problem in her future immigrant visa petition. good luck.

Yes, she can come as a visitor. However, she'll have to qualify for the visitor visa the same as everybody else. That means proving she'll go back to China by the date given to her by CBP at the port of entry.
My guess is that she'll be denied. They'll suspect her intent is to get married in the United States and adjust status, thus avoiding the wait for a K-1. ***Note, numerous US foreign service officers who have posted on this board in the past have said B1/B2 IS a dual intent visa. |
